Definitions

Client : any professional or natural person capable within the meaning of Articles 1123 et seq. of the Civil Code, or any legal entity, visiting the Site subject to these general conditions.

Services and Provisions : https://prefafrance.fr/ makes available to Clients.

Contenu : All elements constituting the information on the Client’s Site, including texts, images, videos.

4. Contractual limitations on technical data

The site uses JavaScript technology. The website cannot be held responsible for material damage related to use of the site. The user undertakes to access the site using recent equipment, free from viruses and with an up-to-date latest-generation browser.

The site is hosted within the European Union, in accordance with the GDPR (No. 2016-679). The hosting provider ensures service continuity 24/7, while reserving the right to interrupt the service for the shortest possible periods (maintenance, improvement or infrastructure failure, abnormal traffic).

PREFAFRANCE and the hosting provider cannot be held responsible for any malfunction of the Internet network, telephone lines or computer and telephone equipment, in particular due to network congestion preventing access to the server.

5. Intellectual property and counterfeiting

PREFAFRANCE owns the intellectual property rights and/or holds the rights of use over all elements accessible on the website, including texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of the site elements, by any means or process, is prohibited without prior written authorisation.

Any unauthorised use of the site or any of its elements will be considered as an act of infringement and prosecuted in accordance with Articles L.335-2 et seq. of the Intellectual Property Code.

PREFAFRANCE acts as publisher of the site and is responsible for the quality and accuracy of the published content. PREFAFRANCE cannot be held responsible for direct and indirect damage to the user’s equipment when accessing the site, resulting in particular from the use of equipment not meeting the specifications of point 4, the occurrence of a bug or incompatibility.

7. Management of personal data

The Client is informed of the regulations concerning marketing communications, the law of 21 June 2014 on confidence in the digital economy, the Data Protection Act of 6 August 2004 and the GDPR (No. 2016-679).

7.1. Controller of personal data collection

For Personal Data collected in the context of browsing the Site and forms, the data controller is PREFAFRANCE, represented by its legal representative.

7.2. Purpose of data collected

  • To enable navigation on the Site and management/traceability of services: connection and usage data, billing, request history, etc.
  • To prevent and combat computer fraud (spamming, hacking…): equipment used, IP address, password (hashed).
  • To improve navigation: connection and usage data.
  • To conduct optional satisfaction surveys : adresse e-mail.
  • To conduct communication campaigns (SMS, e-mail): phone number, e-mail address.

PREFAFRANCE does not sell your personal data; it is used where necessary or for statistical and analytical purposes.

7.3. Individual rights

7.4. Non-disclosure of personal data

PREFAFRANCE undertakes not to process, host or transfer Information collected from its Clients to a country outside the European Union or not recognised as adequate by the European Commission without prior notification to the Client. PREFAFRANCE remains free to choose its technical and commercial subcontractors, subject to sufficient guarantees with regard to the GDPR.

PREFAFRANCE takes all necessary precautions to preserve the security of Information and prevent it from being disclosed to unauthorised persons. In the event of an incident affecting the integrity or confidentiality of Information, PREFAFRANCE will inform the Client as soon as possible and communicate the corrective measures.

8. Incident notification

Despite all efforts, no method of Internet transmission or electronic storage is completely secure. In the event of a security breach, affected users will be notified in accordance with national and European legal obligations.

9. Security

To ensure the security and confidentiality of Personal Data, PREFAFRANCE uses networks protected by standard security devices (firewalls, pseudonymisation, encryption, passwords). When processing data, all reasonable measures are taken to protect them against loss, misuse, unauthorised access, disclosure, alteration or destruction.

10. Hyperlinks, cookies and Internet tags

11. Applicable law and jurisdiction

Any dispute relating to the use of the site https://prefafrance.fr/ is subject to French law. Unless otherwise provided by law, exclusive jurisdiction is granted to the competent courts of Paris.
